We are NOT a government body, NOT affiliated with any political party, and NOT responsible for any action, inaction, response, or outcome from any MLA office, government department, or official. By using this platform, you acknowledge and agree that TNCitizen bears ZERO liability for any consequences arising from complaints filed through this platform.

1. Acceptance of Terms

By accessing or using TNCitizen (tncitizen.in), including the website and WhatsApp bot, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the platform.

2. Platform Role — Facilitator Only

We forward complaints to MLA offices on your behalf. We are not responsible for any response, action, or inaction by MLA offices or any government department. We do not guarantee that your complaint will be resolved or even acknowledged by the MLA office.

3. No Guarantee of Resolution

TNCitizen makes no guarantee that filing a complaint will result in any action, resolution, or response from any MLA office, government department, or official. The platform provides a mechanism for forwarding complaints — the outcome is entirely outside our control.

4. User Obligations

By using this platform, you agree to:

  • File only genuine complaints about real civic issues you have personally witnessed or experienced.
  • Provide accurate information about the location and nature of the issue.
  • Not file false, fake, fabricated, or malicious complaints.
  • Not use the platform to harass, defame, or target any individual, official, or organisation.
  • Not include hate speech, casteist remarks, communal content, or any illegal content in complaints.
  • Only upload photos that you have taken yourself — no copyrighted or third-party images.
  • Not use the platform for any unlawful purpose.

5. Prohibited Content

The following content is strictly prohibited in complaints:

  • False or fabricated information
  • Defamatory statements about individuals or officials
  • Hate speech targeting any community, caste, religion, or group
  • Content that violates any Indian law
  • Copyrighted material you do not own
  • Personal attacks or threats
  • Spam or repeated frivolous complaints

6. Platform Rights

TNCitizen reserves the right to:

  • Reject or remove any complaint without prior notice or explanation.
  • Ban or terminate access for users who violate these terms.
  • Modify, suspend, or discontinue the service (in whole or part) at any time without notice.
  • Edit complaint content for clarity before forwarding (without changing the meaning).

7. Anonymous Forwarding

By using TNCitizen, you understand and agree that your complaints are forwarded anonymously to MLA offices. This means the MLA office cannot identify you through us. Your name and phone number are never included in the forwarded complaint.

8. No Warranty — "As Is" Service

The platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure at all times.

9. Limitation of Liability

To the maximum extent permitted by law, TNCitizen and its owner shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • Use or inability to use the platform
  • Any action or inaction by MLA offices or government departments
  • Any complaint filed through the platform
  • Loss of data or service interruptions
  • Any third-party actions related to complaints

10. Indemnification

You agree to indemnify, defend, and hold harmless TNCitizen, its owner, and team members from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Complaints you file through the platform
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Any content you submit to the platform

11. Law Enforcement Cooperation

TNCitizen may share user data (including personal information) with law enforcement authorities if legally required to do so, including under court orders, government directives, or as required by the Information Technology Act, 2000.

12. Intellectual Property

All platform content, design, logos, code, and materials are the intellectual property of TNCitizen. You may not copy, reproduce, distribute, or create derivative works without prior written permission. Complaints you submit may be used in anonymised, aggregated form for public accountability dashboards.

13. Account Termination

We reserve the right to ban, block, or terminate access for any user who violates these Terms, files malicious complaints, or misuses the platform in any way — without prior notice or liability.

14. Modification of Terms

We may modify these Terms at any time. Updated terms will be posted on this page with a new date. Continued use of the platform after changes constitutes acceptance of the modified Terms.

15. Dispute Resolution & Jurisdiction

Any disputes arising from the use of this platform shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India. Users agree to attempt informal resolution by contacting us before pursuing legal action.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of India, including but not limited to:

  • Information Technology Act, 2000
  • Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
  • Consumer Protection Act, 2019
  • Indian Penal Code (as applicable)

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
